On Dec 28, 2022, Senate Bill S74A, referred to as The Grieving Families Act, was delivered to Governor Kathy Hochul’s office for signature. The bill “provides for the types of damages that may be awarded to the persons for whose benefit an action for wrongful death is brought” which would be a welcomed benefit to families like the Balog’s who lost their 6 year old daughter, Gianna, at a swim camp. The camp was able to continue operating without any changes to policies while the Balog’s were left trying to heal from their devastating loss.
The bill was passed with a majority bi-partisan vote but has yet to be signed by Governor Hochul. It needs to be signed by Monday, January 30, 2023 or it will be considered a pocket veto. New York law provides that “if a bill is sent to the Governor when the Legislature is out of session, the Governor has 30 days in which to make a decision, and failure to act ("pocket veto") has the same effect as a veto.”

But we all know that money talks — an organization will only change its ways when faced with the threat of financial consequences. That is why we need to change the wrongful death law, to safeguard against negligent events from reoccurring and to allow families and loved ones to bring a case based on their own pain and suffering.”
